Privacy Notice

How Xima Group collects, uses and protects your personal data.

In compliance with the Mexican Federal Law on the Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares, LFPDPPP), its Regulations and other applicable rules, Xima Group makes this Privacy Notice available to you.

1. Identity and address of the data controller

Xima Group (hereinafter, «Xima Group»), with address at Sonorense #13463, Col. Chamizal, C.P. 22415, Tijuana, Baja California, Mexico, is responsible for the processing of your personal data.

For any matter related to your personal data you may contact the data controller at serviciocliente@xima.mx or by phone at +52 (664) 900 1966.

2. Personal data we collect

We collect the data you provide to us directly and voluntarily through:

  • Contact and quote form: name, email address, phone number, company, area of interest (IT, architecture, construction or products) and the details of your request.
  • WhatsApp or phone call: the data you choose to share so that we can handle your request.
  • Profile validation form (buyer personas): name, job title and your answers.

We do not collect sensitive personal data (racial origin, health status, beliefs, financial data without your express consent, etc.).

3. Purposes of the processing

Primary purposes (necessary for your relationship with Xima Group):

  • Handling and following up on your requests, enquiries and quotes.
  • Contacting you and preparing commercial proposals.
  • Providing and following up on the contracted services.

Secondary purposes (not necessary):

  • Sending commercial information, promotions and news.
  • Improving our services and the experience on the site.

If you do not wish your data to be processed for the secondary purposes, you may say so by sending an email to serviciocliente@xima.mx. Your refusal will not be grounds for denying you the services you requested.

4. Data transfers

Your data may be shared among the divisions of Xima Group (Xima Constructora, IT & Supplies and Xima Estudio) for the sole purpose of routing your request to the relevant area. We do not transfer your data to third parties outside Xima Group without your consent, except in the cases provided for in article 37 of the LFPDPPP.

5. ARCO rights and withdrawal of consent

You have the right to Access your personal data, to Rectify it when it is inaccurate, to Cancel it when you consider it is no longer required, or to Object to its processing (ARCO rights), as well as to withdraw the consent you have given.

To exercise them, send your request to serviciocliente@xima.mx. Your request must contain and be accompanied by:

  • Your full name and a means of communicating our response to your request.
  • A copy of a valid official identification document proving your identity (or, in the case of a legal representative, the document evidencing such representation).
  • A clear and precise description of the personal data in respect of which you seek to exercise the right, as well as the right you wish to exercise (access, rectification, cancellation or objection).
  • Any element or document that helps locate your personal data.

In accordance with article 32 of the LFPDPPP, we will inform you of the decision adopted within a maximum of 20 business days from receipt of your request. If it is granted, it will take effect within the 15 business days following the date on which we communicate our response. We may extend these periods once for an equal term when the circumstances of the case so warrant.

6. Use of cookies and tracking technologies

A cookie is a small file stored on your device when you visit a website. On this site we use the following categories of cookies and similar technologies:

  • Necessary: essential for the site to work and to remember your preferences (for example, your cookie decision). They do not require consent.
  • Analytics and performance: they let us understand, in aggregate form, how the site is used so we can improve it.
  • Marketing and remarketing: they help us show you more relevant communications on and off the site.

Analytics and marketing cookies are only enabled once you give your consent through the cookie banner shown when you enter the site. You may withdraw your consent at any time by deleting cookies from your browser settings; doing so may affect some features.

7. Changes to this Privacy Notice

We reserve the right to update this Privacy Notice at any time. Any amendments will be made available on this same page, stating the date of the last update.

The processing of your data is also governed by our Terms of Use.
